Where a conversion counterclaim has been asserted by a defendant alleging wrongful garnishment and a delay in returning the garnished funds, the plaintiff’s motion for summary disposition should be allowed in part and denied in part, as the garnishment itself was taken under color of a judgment that was only later set aside, but that does not dispose of the claim that retention of the garnished funds was a conversion.
