Where a plaintiff subcontractor has moved for judgment as a matter of law, summary disposition for the plaintiff under the Construction Lien Act is warranted as to liability despite the defendant’s argument that the plaintiff did not file its notice of furnishing under MCL 570.1109(1) and that this deficiency precludes the plaintiff from enforcing its lien.
